PETALING JAYA - Friday, April 24, 2009: Former Penang Deputy Chief Minister 1 Mohamad Fairus Khairuddin cannot retract his resignation as Penanti assembyman, says state assembly speaker Abdul Halim Hussin.
This is because in his resignation letter, Fairus also included a statutory declaration letter stating he wanted to quit to continue his studies, explained Abdul Halim on Friday.
"When a statutory declaration is made, it is clear that he has already resigned".
"Furthermore, we have also submitted a letter to the Election Commission informing them that the seat is vacant," said Abdul Halim.
"From the view of the law, once he has done that, he is unable to retract his resignation," he added.
When contacted, Fairus, who had reportedly expressed interest in returning as an assemblyman after the Malaysian Anti-Corruption Commission cleared him of graft charges on Thursday, said he would "leave the decision to the leaders".
He said it was up to PKR to decide whether he was able to retract his resignation letter.
Fairus resigned from all posts on April 8, following allegations of involvement in illegal quarry dealings in Penang.
